02

Ryan Kaiser LLC is a Wisconsin limited liability company. References in these terms to “Dock Navigator,” “Ryan Kaiser LLC,” “Company,” “we,” “us,” or “our” refer to Ryan Kaiser LLC and the software, websites, services, and programs it operates under the Dock Navigator name.

By using the services, you represent that:

  • You have the legal capacity to agree to these terms.
  • The information you provide is accurate and current.
  • You will use the services only for lawful purposes.
  • Your use will comply with applicable laws and regulations.

Features and information may differ by facility, geographic area, user type, subscription level, platform version, or device.

05

Driver Responsibility and Safe Use

Dock Navigator is an informational resource. It does not replace professional driver judgment, official facility directions, traffic-control devices, law-enforcement instructions, dispatch instructions, road restrictions, or applicable laws and regulations.

You remain solely responsible for:

  • Operating your vehicle safely and lawfully
  • Confirming that a route is suitable for your vehicle
  • Observing height, weight, length, width, and axle restrictions
  • Following posted road and facility signs
  • Complying with hours-of-service and safety regulations
  • Following directions from facility personnel and dispatch
  • Determining whether an entrance, road, or property is accessible

Do not interact with Dock Navigator while driving.

Review facility information before operating the vehicle or while safely and legally parked. Ryan Kaiser LLC is not responsible for accidents, citations, property damage, cargo damage, delays, or other consequences arising from distracted, unsafe, or unlawful use.

06

Facility Information and Accuracy

Dock Navigator seeks to provide useful facility-arrival information, but facility conditions and procedures may change without notice.

Information may come from facilities, drivers, fleets, dispatchers, publicly available sources, mapping providers, industry partners, or other users.

We do not guarantee that facility information is:

  • Complete
  • Current
  • Error free
  • Officially approved by the facility
  • Suitable for every vehicle or load
  • Available for every location
  • Accurate under current weather or construction conditions

Drivers must verify important information through appropriate sources when circumstances require confirmation.

Official signs, facility personnel, law enforcement, emergency personnel, dispatch instructions, and applicable law take priority over information displayed in Dock Navigator.

07

Early Access, Beta Testing, and Founding Drivers

Dock Navigator may offer early-access, beta-testing, free-access, trial, or Founding Driver programs.

Early versions of Dock Navigator may be incomplete and may contain:

  • Limited facility coverage
  • Features still under development
  • Errors or inaccurate information
  • Temporary interruptions
  • Features that later change or are removed
  • Compatibility or performance issues

Early-access participants understand that the platform is still developing and agree to use it with appropriate caution.

We may limit the number of participants, establish eligibility requirements, change program benefits, discontinue free access, or transition users to a paid plan.

Unless we expressly promise otherwise in writing, free or early-access participation does not guarantee permanent free access, lifetime access, ownership, employment, compensation, equity, or any other financial interest in Dock Navigator or Ryan Kaiser LLC.

08

User Accounts and Platform Access

Certain features may require an account, login link, password, access code, or invitation.

You agree to:

  • Provide accurate registration information
  • Keep your contact information current
  • Protect account credentials and access links
  • Not share access with unauthorized individuals
  • Notify us promptly of suspected unauthorized access
  • Accept responsibility for activity through your account

We may reject, restrict, suspend, or terminate an account when we reasonably believe information is false, access is being misused, these terms have been violated, or continued access creates a security, safety, legal, or operational risk.

09

Subscriptions, Memberships, and Payments

Dock Navigator may offer paid subscriptions, memberships, one-time purchases, fleet plans, or other paid services.

Prices, billing frequency, plan features, and applicable taxes will be presented before you complete a purchase.

By providing payment information and completing a purchase, you:

  • Authorize the applicable charges
  • Represent that you are authorized to use the payment method
  • Agree to provide accurate billing information
  • Authorize recurring billing when the selected plan is a recurring subscription

Recurring subscriptions automatically renew at the disclosed billing interval until canceled, unless otherwise stated at checkout.

Payment processing may be performed by a third-party payment provider. We do not necessarily store complete payment-card details.

We may change pricing or plan features. When reasonably appropriate, existing subscribers will receive notice before a material pricing change applies to a future renewal.

10

Cancellation and Refunds

You may cancel a recurring Dock Navigator subscription through the available account tools or by contacting us.

Unless otherwise stated at checkout, cancellation prevents future renewal charges but does not automatically refund charges already paid.

Access may continue through the end of the current paid billing period.

Except where required by law or expressly stated in a written offer, completed payments are nonrefundable.

Promotional credits, free months, Founding Driver benefits, and facility-submission rewards may be subject to separate eligibility, verification, expiration, and program rules.

11

User Feedback, Facility Data, and Other Submissions

You may have opportunities to submit facility recommendations, entrance locations, check-in procedures, photographs, videos, comments, survey responses, feature requests, corrections, or other information.

You represent that each submission:

  • Is accurate to the best of your knowledge
  • Does not intentionally mislead users
  • Does not violate another person’s rights
  • Does not contain unlawful or harmful material
  • Does not disclose confidential or restricted information
  • Does not create an unreasonable security or safety risk
  • Does not contain credentials, passwords, or access codes
  • Is information that you have the authority and legal right to submit

You remain responsible for the content and legality of your submissions.

We may review, verify, correct, combine, format, publish, decline, remove, or restrict submitted information.

12

License to Use Submitted Information

You retain ownership of original content that you lawfully own.

By submitting content or information to Dock Navigator, you grant Ryan Kaiser LLC a worldwide, nonexclusive, royalty-free, transferable, sublicensable, perpetual license to:

  • Host and store the submission
  • Review and verify it
  • Reproduce and display it
  • Edit, format, translate, or combine it with other information
  • Publish it through Dock Navigator
  • Use it to improve our software, data, and services
  • Create aggregated or de-identified research and business information

This license allows us to operate and improve Dock Navigator without needing separate permission or compensation each time submitted information is used.

Unless agreed otherwise in writing, feedback, ideas, recommendations, and feature suggestions are not confidential and may be used without compensation or attribution.

13

  • Reports, research, and compiled information
  • Trademarks, service marks, and trade dress

Subject to these terms, we grant you a limited, revocable, nonexclusive, nontransferable license to access and use Dock Navigator for your personal use or authorized internal business purposes.

No ownership rights are transferred to you.

You may not copy, reproduce, republish, resell, distribute, scrape, reverse engineer, commercially exploit, or create a competing database or service from Dock Navigator without written permission.

14

Acceptable Use

You may use Dock Navigator for lawful purposes related to transportation, logistics, facility arrivals, fleet operations, product feedback, and other uses authorized by Ryan Kaiser LLC.

You must use reasonable care when relying on information and must not present Dock Navigator information as an official facility instruction unless the platform clearly identifies it as such.

Software Changes, Availability, and Interruptions

Dock Navigator is an evolving software platform. We may add, change, test, limit, suspend, or remove features, facilities, plans, pricing, content, access methods, and integrations.

We do not guarantee continuous or uninterrupted availability. Downtime may occur because of maintenance, development, infrastructure issues, vendor interruptions, security incidents, data corrections, or circumstances outside our control.

We are not obligated to maintain any particular feature, facility profile, software version, subscription plan, or integration indefinitely.

These terms remain effective while you access or use Dock Navigator.

  • Termination is required by law
  • Continued access would harm Ryan Kaiser LLC or another person

After termination, provisions that by their nature should survive will remain effective, including intellectual-property, submission-license, disclaimer, liability, indemnification, governing-law, and dispute provisions.
